Terms of Use

These terms are the agreement between you and APPWILL COMPANY LTD (“we”) about the Desert app and the service behind it. By installing the app or using the service you accept them.

What the service is

Desert routes your device’s traffic through servers we operate, so that the networks between you and those servers see an encrypted connection to us rather than what you are reaching. A paid subscription gives you access to that set of servers. The app can also carry a subscription key issued by a different operator; in that case the connection is to that operator’s servers and this agreement covers only the app itself.

Subscription, renewal and cancellation

• The subscription is sold through the App Store, and payment is charged to your Apple Account at confirmation of purchase. The price and the length of the period are shown in the app before you buy, in your own currency.
• It renews automatically for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period.
• A free trial, when it is offered, is stated on the purchase screen. If you subscribe during a trial, the unused part of it is forfeited.
• You manage and cancel the subscription in the App Store — Settings → your name → Subscriptions — not here. Deleting your account in the app does not cancel the subscription.
• Refunds are handled by Apple under the App Store Terms of Service. We cannot issue them.

Your account

You sign in with Sign in with Apple. One subscription serves a limited number of devices at a time; the app shows you the devices signed in and lets you sign one out. The account is yours alone — do not share its access with others. You can delete the account in Settings → Account → Delete account.

How you may not use it

• Not for anything illegal where you are, and not to harm others: no intrusion into systems, no port scanning or denial-of-service, no spam, no distribution of malware.
• Not to resell the service, and not to work around the device limit.

We may suspend or end access to an account that does these things, or that is used in a way that damages the service for everyone else.

What we do not promise

The service is provided as it is. We do not promise that every server will be reachable at every moment, at a particular speed, or from a particular network: VPN traffic is blocked or throttled in some countries and on some networks, and that is outside our control. We may add, change or withdraw servers. To the extent the law allows, we are not liable for indirect or consequential losses.

Changes

We may change these terms. The current version is always on this page with its date; if a change affects what you get or what you pay, you will be told in the app before it applies.

Terms required by Apple

Because the app is distributed through the App Store, the following apply:

• This agreement is between you and us alone, not with Apple. We, not Apple, are solely responsible for the app and its contents.
• Your licence to use the app is non-transferable and limited to use on Apple-branded devices you own or control, as permitted by the Usage Rules of the App Store Terms of Service.
• We are solely responsible for support and maintenance of the app. Apple has no obligation to provide either.
• If the app fails to conform to any warranty we give, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
• We, not Apple, are responsible for addressing any claim about the app — product liability, a claim that it fails to conform to a legal or regulatory requirement, a consumer protection or privacy claim — and for any third-party claim that the app infringes intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
